Competition Rules: KFC Namibia Bacon Burger Festival

By entering this Competition and/or accepting any prize, all participants and winners agree to be bound by the terms and conditions below applicable to this Competition (“Rules”) and the Promotional Competition Rules (“General Promotional Competition Rules”) applicable to promotional competitions run by Yum Restaurants International Proprietary Limited and/or its agencies (collectively, the “Organisers”) from time to time, which General Promotional Competition Rules shall be read together with these Rules.

Copies of these Rules and the General Promotional Competition Rules are available in all KFC Restaurants in Namibia and websites of participating radio stations. The General Promotional Competition Rules may be amended from time to time in accordance with the terms relating to any amendment/s contained therein.

Competition Period

The Competition will begin on 23 December 2016 and will end on 8 January 2017. No entries will be accepted after 11:59pm on 7 January 2016 (Namibian standard time).

Eligible entrants

All persons, including Namibian Citizens and Foreign Nationals officially residing in Namibia may enter the competition.

However, to enter you must be at least 16 years old.

Participants may only enter on the competition on the following social media platforms: Facebook; Twitter and Instagram.

1. How to enter into the Competition

1.1. Purchase any one of the 3 new Bacon Burger variants: Namibia Original; German Mustard & American Smokey BBQ.

1.2. Take a picture/selfie of you eating one of the KFC bacon burgers.

1.3. Post your picture on any of the following social media platforms: Twitter; Facebook or Instagram, tag KFC @KFCNamibia and Vote for your favourite Burger by using the #BACONBURGERLOVE & your favourite KFC Bacon Burger, #NAMIBIAN, #AMERICAN OR #GERMAN.

For Example

Post picture with KFC tag and hashtags as follows: @KFCNamibia #BACONBURGERLOVE #NAMIBIAN

2. The Nature of the Competition Mechanic

2.1. The competition will run only on the following social media platforms: Facebook, Twitter and Instagram.

2.2. Participants may enter more than once to increase their chances of winning the main Prizes or spot prize KFC voucher give-aways.

2.3. All winners will be announced and notified via social media and radio

2.4. Spot prize voucher winners will be notified within the campaign duration from 28 December 2016 to 6 January 2017 via social media and radio.

2.5. Main prize winners will be notified on the 8 January 2017 via social media and radio.

2.6. If winners do not respond and are not contactable after 5 days, new winners will be selected at the discretion of the organisers.

2.7. Winners may be photographed or filmed for promotional purposes associated with this Competition. Photographs and/or video footage may be published on KFC social media platforms: Facebook; Twitter and Instagram as well as on print press. Participants may refuse the request to be photographed and/or filmed and if so, may submit refusal to the organisers in writing.

General terms

Without detracting in any way from the provisions contained in the General Promotional Competition Rules (except where there is a conflict, in which case these Rules shall take precedence) and the further provisions contained in these Rules above, the following general provisions shall be applicable to these Rules.

The promoter/s of this Competition are the Organisers. The Organisers will interpret the Rules in their sole discretion and reserve the right to amend the Rules at any time in accordance with the provisions contained in these Rules.

The Organisers, their directors, members, partners, employees, agents, consultants, any other person who directly or indirectly controls or is controlled by them or any supplier of goods and services in connection with this Competition and their spouses, life partners, parents, children, siblings, business partners or associates are not eligible to participate in or enter this Competition.

IN THE EVENT OF A DISPUTE, THE DECISION OF THE ORGANISERS WILL BE FINAL AND BINDING AND NO CORRESPONDENCE WILL BE ENTERED INTO. IN THIS REGARD AND FOR FURTHER CLARITY, THE ORGANISERS SHALL BE ENTILTED TO DEAL WITH SUCH DISPUTES (OR ANY FAILURE BY PARTICIPANTS TO FOLLOW THE RULES) IN THEIR SOLE DISCRETION, INCLUDING THAT THE ORGANISERS SHALL BE ENTITLED, IN ADDITION TO ANY OTHER RIGHTS WHICH THE ORGANISERS MAY HAVE IN TERMS OF THESE RULES AND/OR THE GENERAL COMPETITION RULES, TO IMMEDIATELY DISQUALIFY PARTICIPANTS FROM THIS COMPETITION. BY ENTERING THE COMPETITION AND/OR ACCEPTING ANY PRIZE, THE ENTRANTS, USERS AND/OR WINNERS HEREBY INDEMNIFY, RELEASE AND HOLD HARMLESS THE ORGANISERS (INCLUDING THEIR SUBSIDIARIES, HOLDING COMPANIES AND AFFILIATES), THEIR DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS AND CONTRACTORS (THE “ORGANISER PARTIES”) FROM AND AGAINST ANY ACTIONS, CLAIMS AND/OR LIABILITY FOR INJURY, LOSS, DAMAGE, EXPENSE, CLAIM OR DAMAGES OF ANY KIND RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM PARTICIPATION IN THE COMPETITION, AND/OR THE USE, ACCEPTANCE OR POSSESSION OF A PRIZE, AND/OR PARTICIPATION (OR NON-PARTICIPATION) IN A PRIZE-RELATED ACTIVITY.

The Organisers may require the winners (at no fee) to be identified, photographed, filmed and the aforegoing to be published in any media, subject to the participant’s right to decline participating in any such marketing activities. If a winner so declines, notice thereof must be submitted to the Organisers in writing.

ADDITIONAL TO ANY OTHER RIGHTS CONTAINED IN THE GENERAL PROMOTIONAL COMPETITION RULES, THE ORGANISERS RESERVE THE RIGHT TO TERMINATE THE COMPETITION AT ANY TIME WITH IMMEDIATE EFFECT. IF THIS IS THE CASE, THE ORGANISERS WILL PROVIDE A NOTICE ON THE SOCIAL MEDIA: FACEBOOK; INSTAGRAM & TWITTER AND IN ALL KFC RESTAURANTS IN NAMIBIA. IT SHALL BE THE RESPONSIBILITY OF ENTRANTS TO REVIEW THE COMPETITION TERMS & CONDITIONS IN THIS RESPECT. IN SUCH EVENT, ALL ENTRANTS HEREBY WAIVE ANY RIGHTS WHICH THEY MAY HAVE AGAINST ANY OF THE ORGANISER PARTIES AND ACKNOWLEDGE THAT THEY WILL HAVE NO RECOURSE OR CLAIM OF ANY NATURE AGAINST THE ORGANISER PARTIES.

The duration of competition entry may also be extended or curtailed at the sole discretion of the Organisers. If this is the case, the Organisers will provide notice of this on KFC Namibia social media pages: Facebook, Twitter and Instagram. All Entry queries must be directed to KFC Facebook page.
